Contract of Sale

These General Conditions have as their object the purchase of products and services, carried out remotely via telematic network, through the web portal eshop.progeomolini.it, of Progeo Molini, with registered and administrative offices: Via Asseverati, 1 42122 Masone (RE). Each purchase transaction will be governed by the provisions of Legislative Decree No. 185/99 and, as regards the protection of confidentiality, will be subject to the regulations set forth in Law No. 675/96 and subsequent amendments.

Acceptance of Sale

The contract entered into between Progeo Molini and the Customer shall be considered concluded with the acceptance, of the order by Progeo Molini. Such acceptance shall be deemed tacit. By placing an order in the various ways provided, the Customer declares that he/she has read all the information provided to him/her during the purchase procedure, and that he/she fully accepts the general and payment conditions set forth below.

If the Customer is a consumer (i.e. a natural person who buys goods for purposes not related to his professional activity), once the purchase procedure is completed, he will print or save an electronic copy and in any case keep these general conditions of sale, in accordance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance selling and, as regards the protection of confidentiality, will be subject to the regulations set out in Law No. 675/96 and subsequent amendments.

Any right of the Customer to damages or compensation, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property, caused by the non-acceptance, even partial, of an order is excluded.

For each order placed Progeo Molini will issue an invoice for the material shipped, sending it attached to the goods. For the issuance of the invoice, the information provided by the Customer at the time of the order shall be considered authentic. The availability reported on the site is intended as non-binding as the quantity reported may not correspond to the actual stock in the warehouse. Any delays in processing the order will be communicated immediately to the customer

Mode of purchase

The Customer may purchase only the products on the site at the time of placing the order as described in the relevant information sheets. It is understood that the image accompanying the descriptive sheet of a product, may not be perfectly representative of its characteristics but differ in color, size, accessory products present in the picture. All information supporting the purchase is intended as mere generic information material, not referring to the real characteristics of a single product.

Correct receipt of the order is confirmed by Progeo Molini by means of an e-mail reply, sent to the e-mail address provided by the Customer. This confirmation message will contain an ‘Order Number’, to be used in any further communication with Progeo Molini. The message will repeat all the data entered by the Customer, who undertakes to verify their correctness and promptly communicate any corrections, according to the procedures described in this document.

In case of non-acceptance of the order, Progeo Molini guarantees timely communication to the Customer. Right of withdrawal

The Customer is protected by Italian legislation regarding the RIGHT OF WITHDRAWAL (L.D. 15/01/92 N°50).

Pursuant to Article 5 OF D. LGS 185 OF 1999, the customer has the option to withdraw from the contract/order entered into on the Internet without penalty and without the need to give any explanation, subject to the following conditions.

The right of withdrawal lapses:

– In case of non-integrity of the returned goods (packaging and/or its contents).
– Even partial use of the asset and any consumables.
– The lack of the original outer packaging and/or inner packaging.
– Damage to the product due to causes other than its transportation.

To exercise the right of withdrawal, within a period of 14 calendar days from receipt of the products ordered, the customer must send a registered letter with return receipt to the address below. The Communication may also be sent, within the same period, by telegram, email or fax, provided that it is confirmed by registered letter with return receipt within the following 48 hours.

The Communication must contain:
– the manifestation of willingness to avail of the benefit granted by D. Lgs. N. 185 of May 22, 1999
– the indication of the products for which you decide to avail yourself of the right of withdrawal as reported in the purchase order
– the data relating to your bank account (this is to allow the return of the amount due).
– To obtain a refund of the amount due, the customer must, at his own expense, return the purchased products to the following address: Progeo Molini Orders Office, Strada Forghieri 154, cap 41123 Ganaceto (MO) Italy.

The return shipment must be made within 14 calendar days of receipt of the goods and can be made via whatever carrier/courier/shipper the customer deems most appropriate.

It is expressly understood that the cost of returning the product to will remain the responsibility of the customer.

Buying Guide

User registration

it is possible to register in a few simple clicks, to speed up the purchase process. When registering you are asked for your first name, last name, an email address and password, tax code (you will only be able to register by entering an Italian tax code). Within your account you can enter your personal information, shipping address and check the summary of your orders. Once registered, with each purchase you will not need to enter your data again, as you are already registered on the portal. However, it is possible, even from registered, to change some information if necessary. All pages where you will enter your data are protected by SSL certificate that is a cryptographic method by which information is transmitted through the Internet encoded so that no one can intercept it before it reaches the recipient.
